Outgoing Vaad Hakohol Members Accused of - M E S I R A - Arrested Chanina Sperlin and another yid.
C.H.J.C.C. / Vaad HaKohol Update - What Happened Monday - 1st 24 Hours in Office:
The new Vaad went into the JCC offices at 387 Kingston Avenue Monday afternoon. They asked outgoing Board Member Tzvi Lang for the keys.
When he refused to give them the keys they changed the locks. Dr. Lang and the new Vaad disagreed over the status of the Court case that was begun by the outgoing Vaad, and whether or not the new Vaad could take possession of the premises. Dr. Lang wanted to wait for the Court Hearing scheduled for June 3rd.
The new Vaad said that the Restraining Order was cancelled, and the hearing scheduled for June 3rd does not prevent them from assuming their new responsibilities and offices. Dr. Lang refused to give them access to the office at 392 Kingston Avenue. Zev Cadaner attempted to speak with Rabbi Osdoba, but R. Osdoba did not return his call.
In the evening the Vaad had their first official meeting in the JCC office. Among the items on the agenda was the selection of Officers of the JCC Board of Directors and the Vaad HaKohol:
Chairman - Fishel Brownstein
Vice Chairman - Chanina Sperlin
Secretary - Eli Poltorak
Treasurer - Zev Cadaner
Later that night, the new Vaad forced open the door at 392 Kingston Avenue to enter the office. Sholom Rubashkin, Moshe's son and an employee of the Council called the Police. He stood screaming in front of the Council that the Police should arrest everybody. (He was apparently trying to make sure that he would have a minyon to Daven with, when he begins serving his jail sentence, for a felony conviction, next month.)
The Police wanted to arrest someone for breaking the lock, and arrested a bochur who happened to be standing nearby. Chanina Sperlin came to talk to the Police to let the bochur free, and he was arrested himself and taken to the Precinct. When the Police understood that he was a Board Member, and had the right to access to the offices, he and the bochur were released.
It is expected that three outgoing Board Members, Rubashkin, Lang and Plotkin will be back in Court on Wednesday, attempting to prevent the new Vaad from remaining in the offices.
Elections 5769, this Sunday UNITED the entire C.H. with a record voter turnout, united in the message they sent, to the current incumbent dictatorship, that we want change and we will no longer stand for anyone who tries to intimidate us, not to vote.
Sundays Election was actually a REFERENDUM if the community has any respect at all whatsoever, for the Fake Rabbonim who "WARNED" and "FORBADE" the community to vote.
The maximum voter turnout that any C.H. election, ever gets is about 1200 Voters. There are actually about 2450 eligible voters but 1200 voters is the MAXIMUM that ever actually vote, at any Jewish C.H. election.
This Sundays Election received 924 votes of the ACTUAL potential of 1200 Voters, (the max that ever actually vote).
Considering that this Sunday was memorial Weekend when many are out of town, and also considering that there was a very extreme and massive effort by the incumbent dictatorship, trying to intimidate us all, against free elections and to forbid elections in Crown Heights - the fact that in spite of all that, we still got 924 out of a hypothetical maximum turnout of 1200, is the most incredible, landslide victory for Democracy over Dictatorship, in C.H.
It doesn't matter who won the election. Because the REAL WINNERS of Sundays election is the entire Crown Heights community who all voted IN DEFIANCE of the Fake Badataz order which "Forbade them to Vote".
It's about time now, that the fake Badatz figures it out, that the community does not respect their Fake Beis Din with 3 unelected Fake Rabbonim because the entire community voted against their direct explicit "WARNINGS" and direct orders not to vote.
In the end the courts will certainly confirm this election as valid.
But even until such time, while the opposition can keep on squirming and playing games in court and keep on living in denial, hoping that the courts would listen to their unjustified challenge, it doesn't really matter what the courts will say because one thing is for sure an that is that:
924 Voters out of 1200 Voters sent a clear message to the fake Rabbonim that we all do not recognize them and we we are all peacefully and fearlessly united behind true democracy to vote as the Rebbe wants us to.
The community at large wants peace in the Badatz and that can only happen with a Din Torah via Zabla.
Until now, Rabbi Schwei, agreed, asked for and demanded a Din Torah with Rabbi Osdoba, via Zabla.
Rabbi Osdoba says he wants a Din Torah but refuses to agree to Zabla.
The Machlokes will only end when Rabbi Osdoba agrees to Zabla.
Until Rabbi Osdoba is ready to make peace, in the mean time, C.H. is moving forward peacefully united in our nearly unanimous vote for Democracy.
We the entire community of C.H., we ALL WON against those who sought to take away our free choice to vote. United, we all freely chose to do, what the Rebbe asked us to to do, to vote.
This Sunday is a victory for the entire FREE WORLD who refuse to be bossed around by an unelected dictatorship in C.H.
A total of 924 Crown Heights residents voted in Sunday's elections.
4 Vaad Hakohol members were elected,
1) Fishel Bronstein (719),
2) Chanina Sperlin (639),
3) Elie Poltorac (594),
4) Zev Cadaner (513).
4 Gabboim were elected as well,
1) Zalmen Lipskier (687),
2) Mordechai Chein (595),
3) Uri Niasof (565),

There were 3 Locations where you could vote:
1) At 770 - Received 520 Votes
2) At Montgomery and Kingston - Received 265 Votes
3) At Carrol and Schenectady - Received 139 Votes

Whereas this Sunday, Rosh Chodesh Sivan, elections for Vaad Hakohol and Gabbaim of 770 are to be held:
In view of the well known, clear instructions of the Rebbe in this matter (in the Sicha of Shabbos
Parshas Mattos-Massei, 5747 on the importance of the elections and with reference to those who attempted to prevent the elections,) and in view of the bylaws of the community that the elections should be held every three years, it is the right and duty of every resident of the community who is entitled to vote to participate in the elections and to choose whichever of the candidates he feels are appropriate to direct the community and the shul.
The attitude and the unique effort of the Rebbe Melech Hamoshiach with respect to the organization of elections in the neighborhood, is well known. These are his holy words from the farbrengen of Shabbos Parshas Ki Savo, 5747: “In view of the great importance of the matter – something which involves the entire community, all residents of the neighborhood – they will certainly all (who have a right to vote) participate in the elections, and they will not make calculations, that it is not in keeping with their honor or that they are busy with other matters, holy and good as they may be, for such calculations do not come from the side of holiness, rather they come from the left [negative] side [of the heart.] For we are talking here of something that affects the wellbeing of the entire public.”
Further on in that Sicha the Rebbe announced that everyone who would participate in the elections would receive a dollar from the Rebbe to be given to tzedaka.

An Open Letter to the Community:
A few years ago, my son came home from Yeshiva. He told me about the discussions of the day in Yeshiva concerning the arguments between Rabbi Osdoba and Rabbi Schwai regarding the necessity of a filter for tap water. My son told me that the discussion became very heated amongst the bachurim and everyone began taking sides. I asked my son, “Which side did you take?" He answered me, “When it comes to Rabbanim, I don’t take sides." I also have tried very hard to stay neutral, and B”H maintain a good relationship with both Rabbonim.
But as I walked home from Shul Friday night, a Balabos approached me and asked me if I had signed the letter supporting the community elections?
I replied “Yes”, and he asked me why I was taking a side.
The Rabbonim are divided. But the Rebbe said that the Rabbonim should stay out of the election process.
By not voting, am I not taking a side?
If the Rabbonim are arguing over whether you need a water filter, should I have one sink with a filter and one without to be Yotze LaChol Hadaos ( according to all opinions)? If the Rabbonim have a problem amongst themselves, why should they paralyze the democratic process of having elections for Vaad Hakol?
The by-laws on the CHJCC stipulate that there must be elections every three years. Over a year ago the Netizgim (representatives from the shuls in the community) were in the process of holding elections, but the process was halted because one of the Rabbonim claimed there could not be an election until there is Shalom between the Rabbanim.
If it is the case that we have to rely on the opposing Rabbonim and their biased advisers on both sides, then we can be sure that we will never have elections and we will never have a united Bais Din. Then we will never receive an honest accounting of the community finances, and we will never be able to move on.
As I wrote in a previous letter to the community, our "leaders" are failures, and the only way to fix up this community is do it by ourselves and not rely on he "leadership."
In the last few years the respect for the Rabbonim and the community Hechsher has gone way down, the level of tznius has sunken to all time lows, and our self respect as a community has hit rock bottom. How could we tell our children to work out their problems, when the Rabbonim can’t even work out their problems?
The Rebbe spoke out strongly for elections. He gave everyone who voted in the first election a dollar. Have we become a communist regime that we don’t have any right to pick our community leaders?
If the Rabbonim have problems let them handle it in a Bais Din. If they can’t…….
It’s time for the community to open up it’s eyes. No matter how much good a Vaad member does, he cannot become a dictator. There need to be elections now, and if you don’t vote now then don’t complain later.
It’s very easy to complain about the candidates' qualifications (or lack thereof). Especially when you do it anonymously, so you don’t have to take the heat for your words. If people think they could do better, then they should have run. If we don’t vote in this election and vote en mass, then we will definitely not have Shalom, and we will be able to blame only ourselves.
Friday, a bunch of thugs ripped down signs for the upcoming candidate forum.
Communism seems to be alive and well in Crown Heights! If you don’t vote, then you are voting for communism.
Going to court to stop the elections will definitely not bring Shalom to this community. It’s a terrible waste of community resources.
If we just look the other way without protesting, then we deserve what we get.
May we all be Zoche, to see the real Shalom with Mashiach Tzidkanu.

3 - Todays Hearing has been delayed for 2 weeks until June 3d
4 - This means that elections are now delayed for at least 2 weeks, until June 3d.
5 - However there is a slight possibility that it could be appealed tomorrow, Thursday morning, but the parties involved have not yet made that decision if they are interested in appealing it Thursday Morning.

Many observers suspect that this means that the corrupt plaintiff MOSRIM (Rabbi Osdoba's Shluchim) was seeking (Krisnky's and Shemtov's Help) to pull strings behind the scenes to get "a Judge they know", much like Mr. Krinsky regularly wins cases in court this way by using Judges "He Knows".

It has long been assumed that Rabbi Osdoba who has demonstrated that he is very fearful of democratic elections, will stoop to the level of going to Goyishe Court, at the very last second, before elections, in attempt to try to block democracy in Crown Heights.
Daas Hakohol has now confirmed that Rabbi Osdoba, did indeed, once again send his shluchim, to go to goyishe court today.
Rabbi Osdoba (via his shluchim) will be asking the Goyishe Court for a TRO in his attempt to block the Rebbe's Democratic Elections in C.H., this Sunday.
The hearing takes place TODAY, Wed, 5/20/09, 3:00 pm, at Brooklyn Supreme Court (Borough Hall stop on the train).

The Beis Din Tzedek of America - Ein Moshe (Rabbi Herbst) has now confirmed that Rabbi Avrohom Osdoba is still now, currently IN CHEREM because of him being a party to Going to Goyishe Court and refusing to listen to a Psak Din Torah, he was involved in.
Rabbi Herbst Beis Din writes that it is forbidden to be Metzaref Rabbi Osdoba to a Minyan, His Hashgocha is invalid, he is Posul L'Eidus, because he is now IN CHEREM.

We all know what Rabbi Osdoba wants, but What does the Rebbe want and what does the Rebbe and Rambam say, that we must all do?
The Rebbe told Rabbi Osdoba that it is FORBIDDEN for rabbi Osdoba to get involved in elections for Vaad Hakohol.
The Rambam (quoted below) says that if Rabbi Osdoba contradicts the Rebbe, we must listen to the Rebbe and not listen to Rabbi Osdoba.

The entire community was peaceful and united, about the forthcoming elections, next Sunday, until Rabbi Osdoba is now once again, taking his personal and private Machlokes, in to the streets of CH.
Rabbi Osdoba wants to "punish" all residents of CH, denying them their fundamental right to vote, just because he happens to have a personal and private dispute with his fellow and equal Chaver Habeis Din.
Daas Hakohol interviewed many residents on the streets of C.H. who were outraged, why Rabbi Osdoba can't keep his Machlokes private.
Residents of C.H. expressed their concern that it is MACHLOKES LETTERS like this one, initiated by Rabbi Osdoba, which causes us to loose our youth because letters like this make all of our youth loose all respect for all Rabbonim and for all of Yiddishkiet period.

Why are some of the Incumbent Vaad HaKohol and Gaboim Not Running?
A number of those presently serving in the position of Vaad HaKohol and Gaboim have not announced their candidacy in the current elections.
Here are their reasons:
Vaad HaKohol
Leibish Nash
Mr. Nash supports the elections and encourages all community residents to vote. He feels he has served his time, and also expects the elections to be contested in the Courts by Rubashkin. He expects a many months battle over the resources of the JCC. In the meantime he intends to continue filling the void in community services that exists while others fight in court.
Tzvi Lang
Mr. Lang intends to fight the elections until Moshe Rubashkin is released from jail.
Shmuel Plotkin
Rabbi Plotkin says the elections are illegal and no one should go to vote.
Gaboim
Yosef Losh
Mr. Losh checked with Rabbi Osdoba and was told not to run.
Menchem Gerlitzky
Mr. Gerlitzky checked with Moshe Rubashkin and was told not to run.
Avroham Holtzberg
Mr. Holtzberg is out of town for several weeks. He gave permission for signatures to be collected and filed for him, however he could not be reached to sign the application.
